This Acceptable Use Policy ("AUP") defines the acceptable and prohibited uses of the NYOXA LABS website, communication channels, and services. By accessing or using our services, you agree to comply with this AUP. This policy is designed to protect our clients, our infrastructure, and the integrity of our cybersecurity assessment processes.
1. Prohibited Uses
You may not use NYOXA LABS services, website, or communication channels to:
- Unauthorized Testing: Request or conduct security testing on any system, network, or application for which you do not possess explicit, written authorization from the legal owner or authorized representative.
- Misrepresentation: Submit false, misleading, or inaccurate information, including but not limited to false claims of ownership or authorization for testing targets.
- Illegal Activities: Engage in any activity that violates local, national, or international laws or regulations.
- Harmful Content: Upload, transmit, or distribute any malicious code, viruses, malware, or other harmful content.
- Disruption: Attempt to disrupt, degrade, or interfere with the functionality or performance of the NYOXA LABS website, services, or any associated infrastructure.
- Harassment or Abuse: Harass, threaten, impersonate, or engage in any abusive behavior towards NYOXA LABS personnel, clients, or other users.
- Data Misuse: Use any deliverables, reports, or information obtained from NYOXA LABS services for unlawful activities or in a manner that misrepresents NYOXA LABS' findings or recommendations.
- Social Engineering: Attempt to conduct social engineering attacks against NYOXA LABS employees or clients.
2. Authorized Requests Only
All requests for cybersecurity assessments or related services must involve systems where you are the legitimate owner, operator, authorized employee, or duly appointed legal representative. NYOXA LABS reserves the right to request proof of ownership or authorization at any time. Failure to provide adequate proof may result in the refusal or termination of services.
3. Rules of Engagement Reference
For formal engagements, specific Rules of Engagement (RoE) will be established and agreed upon in writing. These RoE will detail the precise scope, testing methodologies, communication protocols, and any limitations or exclusions for the assessment. Adherence to these RoE is mandatory.
4. Service Refusal and Termination
NYOXA LABS reserves the right to refuse or terminate services, without liability, if:
- Authorization for testing is unclear, insufficient, or revoked.
- Client conduct is deemed unsafe, unethical, or in violation of this AUP.
- Requests appear unlawful, abusive, or pose a risk to our operations or reputation.
- The client fails to adhere to the agreed-upon Rules of Engagement.
5. Liability Waiver for System Instability
Client acknowledges and agrees that cybersecurity testing, by its nature, may introduce instability or temporary disruption to target systems. While NYOXA LABS employs best practices to minimize such risks, the client expressly waives any claims against NYOXA LABS for system instability, downtime, or data loss that may occur as a direct result of authorized testing activities, provided such activities were conducted within the agreed-upon scope and methodologies.
6. Cloud Service Provider (CSP) Notification
If the systems to be tested are hosted on a Cloud Service Provider (CSP) platform, the client is solely responsible for obtaining any necessary permissions from the respective CSP prior to the commencement of testing. The client must inform NYOXA LABS if such notifications or permissions are required and provide evidence of their acquisition.
