How payments, cancellations, and refunds are handled for NYOXA LABS cybersecurity services.

This Refund Policy outlines the terms and conditions for payments, cancellations, and refunds related to cybersecurity services provided by NYOXA LABS.

1. Project-Based Services

For all scoped cybersecurity assessments and project-based services, payment terms, including any required deposits, milestones, and final payments, will be explicitly defined in the mutually agreed-upon proposal, statement of work (SOW), invoice, or written service agreement. These documents will supersede any general terms outlined herein.

2. Deposits

Deposits may be required to reserve assessment time, allocate resources, and initiate project planning. Once scheduling, scoping, preparation, or any assessment work has commenced, deposits are generally non-refundable. The specific non-refundable nature of a deposit will be clearly stated in the engagement documentation.

3. Cancellations

Clients are requested to notify NYOXA LABS as early as possible if a project needs to be cancelled or rescheduled. Cancellation eligibility and any associated fees will depend on the project status, the amount of work already performed, and the specific terms outlined in the written service agreement. Early notification may mitigate cancellation charges.

4. Refund Eligibility

Refunds for services may be considered under the following circumstances:

  • Work Has Not Started: If no work, including scoping, preparation, or resource allocation, has commenced for the project.
  • Assessment Time Not Reserved: If no specific assessment dates or resources have been formally reserved.
  • Legal or Agreement Mandate: If a refund is explicitly required by applicable law or a specific clause within the written service agreement.

Refunds are generally not available for:

  • Completed work or delivered reports.
  • Consulting time already utilized.
  • Emergency or expedited services already performed.
  • Services for which the assessment window has passed.

5. Refund Processing

Eligible refunds will be processed within 30 business days of approval. Refunds will be issued via the original payment method unless otherwise agreed upon. Please note that processing times may vary depending on the financial institutions involved.

6. Currency Exchange and Transaction Fees

For international transactions, refunds will be processed in the original currency of payment. NYOXA LABS is not responsible for any fluctuations in currency exchange rates or any transaction fees imposed by banks or payment processors during the refund process.

7. Definition of Project Commencement

For the purpose of this policy, "Project Commencement" is defined as the earlier of:

  • The date specified in the written service agreement for the start of work.
  • The date when NYOXA LABS begins any scoping, planning, resource allocation, or preparatory activities for the project.
  • The date when a deposit becomes non-refundable as per the engagement documentation.

8. Changes to This Policy

NYOXA LABS reserves the right to update this Refund Policy at any time. Any changes will be posted on our website with a revised "Last updated" date.
